Angry Terminated after workers comp case... New York

I was recently terminated from his job of 8 years. I recently filed a workers comp case due to an injury to his knee at work. The injury is now so bad, I have just found out that I will need surgery to correct it. Once we talked with the surgeon, my position was terminated. The reason for my termination they say was because of not following procedure at work.

I am a delivery driver, and my boss followed me to one of my stops without my knowledge. My boss sat in his car and watched me do my delivery. After my day had ended, he then called me to his office to let me know that he was watching me, and I did not have my helper guide me when i was backing up, and that was against policy. Policy states in the company hand book, if ever being issued a warning, a verbal warning would be given, then a written warning, a final written warning, then termination. The only warning I recieved was termination... NOTHING else. I have not had any other warnings, other then that. My helper on the other hand has been written up for the same warning before. They did not release him, and gave him another written warning. Other drivers have had speeding tickets, and have made no call/ no shows to work... and are still working there to this day. I was an excellent employee compare to all the rest.

Today I recieved a text message from my supervisor who is also a friend. He stated that the Vice President of the company just wanted me out, and that my boss didnt want to do it. I am almost 100% sure this is because they feel i was a liability because of my injury. Do I have a case???
